Please read the following booking conditions carefully which outline our obligations to you, and your responsibilities to us.

Schoolie’s Road Trip 2006 Tours are designed for those in the school leaving age range, typically 17  to 19, and accordingly we reserve the right to refuse booking for passengers outside this age range

WHAT’S INCLUDED IN OUR PRICES
All coach transportation as outlined in our itineraries.
Services of a Driver/Tour Leader and Host. (Mini-coaches - 25 seats) have a Driver/Tour Leader only)
All accommodation costs incurred during the tour.
All meals as specified in our itineraries.
All ferry crossings and launch cruises as outlined in our itineraries.

WHAT’S NOT INCLUDED IN OUR PRICES
Personally incurred expenses such as alcoholic drinks, souvenirs, telephone, email, laundry charges, optional excursions etc.
Meals or accommodation whilst travelling to or from your homeport to connect with your holiday.
Any travel cost incurred of whatever nature to or from your homeport.
Any charges levied by island resorts for use of their facilities.

LUGGAGE
Luggage is restricted to one reasonable sized suitcase and a small day pack.

INSURANCE
You are required to take out travel insurance to cover for loss of deposit, cancellation charges, medical expenses, damage to luggage and additional expenses. Your Travel Agent will be happy to arrange your insurance cover. You will not be accepted on a holiday unless you have arranged insurance cover.

WEBSITE & FLYERS
Sydney Adventures has made every endeavour with the production of it’s website & flyers to ensure its validity. Sydney Adventures believes that the contents of this website and its flyers are correct at time of printing, but all prices and services described herein are subject to change or withdrawal without notice.

CHANGES IN ITINERARY
Sydney Adventures reserve the right to make changes to an itinerary if something beyond the control of Sydney Adventures deems it necessary.

PRE AND POST TOUR TRAVEL AND ACCOMMODATION
Sydney Adventures is not responsible for travel arrangements and costs incurred in getting to the point of commencement of the holiday, or from the point of conclusion of the holiday.

DRIVER/TOUR LEADERS
Sydney Adventures contracts Driver/Tour Leaders to operate every holiday. You agree to accept the authority of such leaders and comply with their decisions. In the event a Driver/Tour Leader requires a passenger to leave a trip, no refund will be given. That passenger is also responsible for their return transportation costs and will have no claim against Sydney Adventures.

HEALTH
Clients must inform Sydney Adventures of any pre-existing medical problems. In certain circumstances Sydney Adventures may request a doctor's certificate certifying fitness to travel.

BAGGAGE
Sydney Adventures will not be held responsible for any loss or theft of baggage or belongings. Travel insurance is strongly recommended to cover such an event.

PRIVACY
Sydney Adventures is committed to the privacy of both existing and prospective clients. Sydney Adventures respects and shares concerns of our clients over the protection of their personal information. It is for this reason Sydney Adventures adheres to the new privacy sector provisions of the Privacy Act 1998. We will only gather personal information that is necessary for the operation of the organisation in order to deliver the best possible product and service to you.

DIRECT MARKETING
We conduct all direct marketing efforts to provide the best service and product to you. We may at times send you information and offers that we feel may be of interest to you. If you no longer wish to receive any direct marketing material please contact bushire@sydneyadventures.com.au at any time.

LIMITATIONS OF LIABILITY
The responsibility of Sydney Adventures as Tour Operator and/or their agents is limited. They act only in the capacity of agents for carriers', hoteliers', or other service providers in all matters pertaining to accommodations, sightseeing tours and as such, shall not be liable for any personal injury, death, damage, loss, accident, delay or irregularity which may be occasioned either by reason of any defect in any vehicle, or through the acts of default of any company or person engaged in conveying you or in carrying out the arrangements of the tour or otherwise in connection therewith. Under no circumstances is Sydney Adventures responsible for:
a) Delays, personal injury, property damage or any loss resulting from any Act of God, labour stoppages, mechanical breakdowns or participation in sport or activities.
b) Any act of neglect of any person or company whose services are retained by Sydney Adventures for your benefit including, but not limited to accommodation and transportation companies.
c) Any deviation, delay or curtailment of any kind, however caused.
Additional expenses, if incurred under any of these circumstances, will be borne by you

CHANGES TO RESERVATIONS
Sydney Adventures reserves the right not to accept replacement passengers for bookings for any tour for which there is a waitlist. An administration fee of AUD100 per person will apply for each replacement passenger accepted after deposit has been received.

MAKING YOUR OWN TRAVEL ARRANGEMENTS
When arranging your own connecting air travel in conjunction with your tour, please ensure your flight arrives the tour departure day.

ILLICIT SUBSTANCES
Sydney Adventures reserves the right to deny boarding of any persons in possession of illicit substances.

SCHOOLIE’S ROAD TRIP 2006 BOOKING FORM:
All adult passengers (18 years and over at the time of booking) must submit a fully completed and signed Schoolie’s Road Trip 2006 Booking Form which can be print from the website www.sydneyadventures.com.au, with proof of age with their deposit. All minors (17 years and under at the time of booking) must submit a fully completed and signed Guardian Consent form with their Schoolie’s Road Trip 2006 Booking form, with proof of age with their deposit. In the event that any of the Booking Form/Guardian Consent Form/Proof of Age/name details are not supplied at the time of deposit, Sydney Adventures may, in it’s absolute discretion, cancel the booking of the passenger in respect of whom the required documentation/information has not been provided, refund the deposit in respect of that passenger.


TOUR CONDITIONS

1. No agreement exists between you and Sydney Adventures until we have received your deposit monies.

2. Cancellations, for whatever reason, will be subject to the following charges: prior to 60 days of departure, forfeiture of your AUD200 per person non-refundable, non-transferable deposit, regardless of fare paid; between 60 and 30 days of tour departure, 50% of total fare; less than 30 days notice or non-appearance at time of tour departure, 100% of total fare. Additional handling/service fees may be imposed by your travel agent. Please note that the transfer of an existing tour booking to a new tour is regarded as a cancellation of the first tour booking and is subject to the applicable cancellation fees.

3. We may not be required to refund any portion of your fare nor pay any expenses whatsoever including any transportation, medical or living expenses if you leave the tour early, and any such expense which is reasonably.

 4. Subject always to our right to limit liability under applicable law or convention:
(i) We shall not be liable for the death, injury or sickness of any passenger however arising and whether or not arising in the course of performance of the cruise, unless caused by our proven negligence in which case our liability is limited to AUD200,000.
(ii) Where the Trade Practices Act 1974 applies and it is not possible to exclude, restrict or modify any conditions, warranties or other rights implied into this contract, Sydney Adventures’ liability for any breach of condition, warranty or other right is limited to supplying the relevant tour again or the cash equivalent.
(iii) We shall not be liable for the loss of or damage to any luggage or goods, including valuables, however arising, unless caused by our proven negligence, in which case our liability is limited to AUD1,500.
(iv) Any compensation payable by us up to the limits referred to in (i) (ii) and (iii) above will be reduced in proportion to any contributory negligence by you.

5. Luggage shall be deemed to have been delivered undamaged to you unless written notice of any loss or damage is given to us within 72 hours from the date you leave the tour. Failing receipt of the written notice within 72 hours, any action, claim, suit or proceeding and all rights whatsoever and howsoever shall be absolutely barred and extinguished.

6. Except where it operates as a carrier, Sydney Adventures acts only as an agent for airlines, bus companies, hotels, shore tour operators and boat or dive operators. Accordingly, we shall not be liable in connection with any of these principals’ services. Nor shall we be responsible for information supplied concerning any of those principals’ services. Our responsibility does not extend beyond the bus. Whenever you leave the bus, any arrangements made by or for you are at your own risk.

7. Any action, claim, suit or proceeding arising out of or connected in any way with this contract or the tour shall only be brought in New South Wales and shall be governed by New South Wales law as shall this contract. Subject to clause 5 any claim must be notified in writing to Sydney Adventures within 28 days of you leaving the ship or the date you first had knowledge of the material facts giving rise to your claim, whichever first occurs. Any action, claim, suit or proceeding must be commenced within one year of you leaving the tour or of the date when you first had knowledge of the material facts giving rise to your claim, whichever first occurs. If either of these conditions is not complied with, any action, claim, suit or proceeding and all rights whatsoever and howsoever shall be absolutely barred and extinguished.

8. You agree that in entering into this contract Sydney Adventures is acting as agent or trustee on behalf of the tour, its owners, its operators, the Driver, crew, any staff or agents of Sydney Adventures, any charterer of the bus and any substitute bus, its owners, its operators, its Driver and crew and that all such entities and persons shall have the benefit of all rights and exemptions contained in these Passage Conditions. You undertake not to make any claim against any person or entity other than Sydney Adventures and if such claim should nevertheless be made, you agree to indemnify Sydney Adventures and the person or entity against whom such claim is made against the consequences thereof
